For 53 years, the Dayton’s holiday shows brought magic and wonder to countless Minnesotans, who wandered thorugh fantastical storybook scenes brought to life by animatronics and artistry. We welcome you to share a photo or memory with us as we celebrate the Twin Cities PBS original film, “Remember the Magic: A Look Back at the Dayton’s Holiday Shows.”
These Terms and Conditions (“Terms”) govern Twin Cities Public Television, Inc.’s (“TPT,” “we” or “us”) use of content—including, but not limited to, photos, stories, and video—submitted to TPT by you or posted by you to any of TPT’s social media accounts (“Content”). By submitting, posting, tagging, or otherwise providing your Content to us, you agree to these Terms.
You grant TPT, and anyone authorized by us, the non-exclusive, unlimited, irrevocable, non-royalty bearing, transferable and sublicensable right and license to use, modify, publish, or display your Content as desired in TPT’s sole discretion, in whole or in part in any form, format, manner or media now known or hereafter devised, for any distribution, promotional, publicity, derivative, ancillary or other purpose, an unlimited number of times in perpetuity throughout the universe. In connection with the exercise of these rights, you grant us, and anyone authorized by us, the right to identify you as the author of any of your postings or submissions by name or social media username, as we deem appropriate. You will not receive any compensation for the use of any Content you submit. You understand that TPT has no obligation to use your Content, and we, in our sole discretion, may remove or refuse to post your Content (to the extent within our control).
You represent and agree: (i) that you are 18 years of age or older; (ii) that you are the owner of any Content you post or submit, or are making your posting or submission with the express consent of the owner of the Content; (iii) that you are making your posting or submission with the express consent of anyone pictured in any Content you post or submit and/or the consent of the parent or guardian of anyone appearing in the Content who is under the age of 18; (iv) that the Content complies with all applicable terms of use and/or standards of conduct on the social media platform on which you submitted or posted the Content; (v) that the Content will not violate any third-party rights, including intellectual property, privacy, or publicity rights; and (vi) that you will indemnify and hold harmless TPT, our affiliates, and each of our and their respective directors, officers, managers, employees, shareholders, agents, representatives and licensors, from and against any liability and costs incurred, including, without limitation, attorney’s fees and costs, of any nature arising out of or related to the use of any Content, your violation of these Terms, or your breach of any law or rights of a third party.
These Terms are governed by and construed in accordance with the laws of the state of Minnesota, without regard to conflicts of laws provisions. The appropriate state or federal court located in the state of Minnesota will have exclusive jurisdiction for any action or proceeding arising out of or related to these Terms.
